Another way you can avoid the cost of probate is to get rid of your property during the course of your lifetime. The probate fees can only be paid based on the assets are available at the time of your death. There are also tax issues that must be considered as well. Many people choose to dispose of their assets by giving them away in the form of gifts. However, if you do this, it is important to keep a record of when the gift was given, and write down how much it was worth. This documentation can be presented at a later date.
It should also be noted that if you create a will before you are married, that will may be revoked once you are married. This means that you will need to write another will. The only exception to this is those that make a declaration in their will that it has been created for the contemplation of them being married. This is extremely important. If it is not present in your will, it will be revoked when you get married. When you right the will, not only will you want to take your biological children into consideration, you will want to look at any dependents that you may have.
If you have assets, but are hesitant about creating a will, this can cause a number of problems if you should suddenly pass away. The last thing you should want is your family fighting over your wealth. If you have worked hard to build up what you have, you should write a will letting everyone know exactly who the assets will go to. A lawyer will assist you in making sure it is written in a clear language. There should be no doubt as to who particular assets should be given to. It is also important for you to make sure you choose a lawyer that has a good reputation. A will is a serious document, and it is not something you will want to take lightly. Take the time to make sure it is clear and accurate.
